AppCharge Ltd. (“AppCharge”, “we”, “us”, “our”) values your privacy. This privacy policy (the “Policy”) describes our practices with respect to Personal Data (as defined below) which we receive or collect in relation to your access and use of our website, https://www.appcharge.com/ (the “Site”) and our applications, products and services that we provide and offer (the “Services”).
The term “Personal Data”, as used in this Policy, means information relating to an identified or identifiable natural person.
We may change this Policy from time to time in order to keep you apprised of our data collection and use practices. We encourage you to regularly visit and review this Policy to stay informed of such practices.
SUMMARY
Purpose of the Policy – This Policy applies to personal data of website visitors, customers and their employees, which Appcharge processes as the data controller.
Personal Data We Collect – We collect most of the personal data related to you when you access and use our Services, when you engage with our Site, when you contact us or when you apply for an open position at Appcharge.

How (and with whom) we Share Personal Data – We share information with our service providers as necessary to facilitate our business. We will share information when we change our corporate structure, and we will share the information with our affiliated entity.
Cookies and other tracking technologies – We use cookies and other tracking technologies to collect and store your information.
Security of Personal Data – We implement physical, technical and organizational measures to secure your Personal Data from loss, misuse, unauthorized access or disclosure, alteration or destruction.
Communications – You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send.
Personal Data Retention and Deletion – We retain different types of Personal Information for different periods, depending on the purposes for processing the information, our legitimate business purposes as well as pursuant to legal requirements.
Specific provision for EEA residents – If we process Personal Data related to you when you are in the EEA, further terms apply to our processing in relation to your rights as a data subject under EEA data protection laws.
Transfers of Personal Data to other Countries outside the EU or EEA – We may transfer, store, and process your information in countries other than your own, in accordance with applicable law.
Your California Privacy Rights – If you are a California resident, you are entitled to specific privacy rights.
Third Party Websites, Services & Data Collection – Our Site and Services may link to third party websites and services. We are not responsible for and have no control over the data collection practices of such third parties.
Personal Data of Children – The Services are not directed to children under 18, and we do not knowingly collect Personal Data from children.
Changes to this Privacy Policy – We will update this privacy policy from time to time after giving proper notice.

- The Personal Data We Collect and How We Use It.
The categories of Personal Data we collect and process depend on how you interact with us or our Services and the requirements of applicable law. Certain Personal Data is collected automatically, while other Personal Data is provided by you voluntarily, for example, when you contact us.
- Personal Data provided by you.
- Purchase Information. When you access and use our Services, such as our webstores, in order to make a purchase, we collect certain Personal Data, including your city and country of residence as well as your zip code or postal code and your e-mail address. We also collect transaction data (purchased item, time and date of purchase, payment method used; payment and transaction ID number from the respective payment service provider).
- Payment Details. When you make a purchase via our webstores you may provide our third-party payment processor with your billing information, such as your name, credit card number, card expiration date, CVV code, banking information, and/or billing address. Any provision of information to a third-party payment processor is governed by such third-party processor’s terms and conditions. Appcharge does not collect and is not the controller of such payment details.
- Support Information. When you contact us, for example to get a demo of our Services, or provide us with feedback, or for any other reason we will receive and process any Personal Data that you provide to us, such as your full name, phone number and email address, and company name where relevant. In addition, we will collect any Personal Data that you will provide to us while communicating with us, for example via our messaging platform.
- Personal Data Automatically Collected
Device and Technical Information. Through our Site we may collect information about the devices used to access Services, including the following: IP Address, referring URL and domain, device type and device model, operating system and version, browser type and version, information automatically sent by your browser and contained in HTTP headers, and site activity (including what you click on, date and time of your visit).
- Job candidates
If you are sending us a job application or job inquiry we will ask you to provide us with Personal Data about yourself so we can evaluate your application. If this information is not provided, our ability to consider you as a candidate may be limited. All information is provided on a voluntary basis and you determine the extent of information that you provide to us. The kind of information we collect from job candidates can include:
Your first and last name, email address, a home, postal or other physical address, other contact information, title, occupation, industry, personal interests, CV, work permit or visa information (where applicable), educational and employment history, referrals and references, job preferences, and other information you provide us with.
- How Personal Data is Used
We process Personal Data relating to you for a variety of reasons, depending on how you interact with our Services, including:
- To deliver and facilitate delivery of services to you. We may process your information to provide you with the requested service and to perform the contract between you and Appcharge, which includes sending you the purchased software and sending you a receipt.
- To display the correct currency and taxes for users of our webstores.
- To identify a user.
- To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
- To protect, manage and customize our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
- To analyze traffic of users and visitors and identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
- To determine the effectiveness of our marketing and promotional campaigns.
- To enable Site functionality
- To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.
- To improve the delivery of services to the user. This includes customer support and troubleshooting, process and usability improvements, performance analysis
- If you are a job applicant, we use the Personal Data collected to evaluate and assess your job application and suitability for the relevant position, and to further contact you if the application process is successful.
We will process, use, retain and share Personal Data solely for the purposes described in this privacy policy and only when reasonably necessary and proportionate to achieve such purposes for which such information was collected and processed.
To the extent relevant and possible, we will make efforts to maintain the Personal Data accurate, complete and up to date.
- How (and with whom) we Share Personal Data
A. Sharing with third parties to provide our Services
The categories of third parties with whom we share Personal Data are described below.
• Service Providers. To assist us in meeting business operations needs and to perform certain services and functions, we provide Personal Data to vendors and service providers, including providers of hosting services, cloud services, and other information technology services providers, email communication software, and web analytics services, among others (“Service Providers”). Pursuant to our instructions, these parties will access, process, or store Personal Data only in the course of performing their duties to us.
Affiliates. We share Personal Data relating to you with our affiliates, meaning an entity that controls, is controlled by, or is under common control with Appcharge, for our administrative purposes including activities such as IT management, for them to provide services to you, or to support and supplement our Services.
B. Sharing With Third Parties to Protect Us or Others
We will disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. In addition, we will disclose or use users’ Personal Data to defend or enforce our legal rights and in accordance with any applicable law.
C. Disclosure in the Event of Merger, Sale, or Other Structural Change
In the event that we, or a part of our business, are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider (together, a “Structural Change”), we will transfer Personal Data relating to you as part of the Structural Change, provided that the receiving entity will comply with this policy.
- Cookies and other tracking technologies

- Apple, inc. provides us login features which allows us to receive information in connection with your Apple profile in order to provide you services in our stores. - Facebook, Inc., provides us login features known as “Facebook Connect”. This allows us to receive information in connection with your public Facebook profile in order to provide you services in our stores. - Security of Personal Data
We take steps to ensure that Personal Data is treated securely and in accordance with this Policy. We have put in place appropriate physical, technical and organizational controls to safeguard and secure Personal Data related to you from loss, misuse, unauthorized access or disclosure, alternation or destruction. These measures provide industry standard security.
However, no system is 100% secure, and we cannot guarantee or warrant that the Services or our website will be immune from cyber-attacks, malicious activities, malfunctions, honest mistakes or other types of abuse and misuse. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.
- Communications
We and our Service Providers will use your phone number or your email address to send marketing communications or newsletters in order to contact you about the use of our Services, or to promote services which we believe you will be interested in.
If you communicate with us, phone calls may be recorded for staff training or sales quality purposes.
If you do not wish to receive such communications, you may notify Appcharge at any time by sending an e-mail to: Privacy@appcharge.com or by following the “unsubscribe”, “stop”, “opt-out” or “change e-mail preferences” instructions contained in the Communications you receive.
- Personal Data Retention and Deletion
We retain different types of Personal Data for different periods, depending on the purposes for processing such information, our legitimate business purposes as well as pursuant to legal requirements under the applicable laws.
We may store Personal Data for longer periods of time than stated in Section 1 above: (i) where we believes we are required to do so to comply with laws or in connection with legal proceedings; (ii) to resolve disputes; (iii) to enforce agreements between us and others; (iv) when the information is related to a potential or actual legal dispute.
We will keep aggregated non-identifiable information without limitation, and to the extent reasonable we will delete or de-identify potentially identifiable Personal Data, when we no longer need to process the information.
In any case, as long as you use the Services, we will keep information about you, unless applicable law requires us to delete it.
- Specific provision for EEA, UK and Swiss residents
Under the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”), we are considered a data controller with respect to the Services we provide to you, or with respect to the information you provide us as a job candidate. If you are a resident of a territory in the European Economic Area (“EEA”), the United Kingdom or Switzerland, we base our processing of Personal Data as a data controller on the following lawful grounds:
- Performance of a contract with you when we provide and maintain our Services. When we process your account information, and technical information solely to provide our Services to you, this information is necessary to be able to perform our contract with you and to provide our Services. If you do not provide this information, we may not be able to provide our Services to you.
- Our legitimate interests in protecting our Services from abuse, fraud, or security risks, or in developing, improving, or promoting our Services. This may include the processing of account information and technical information.
- Your consent when we ask for your consent to process Personal Data relating to you for a specific purpose that we communicate to you. You have the right to withdraw your consent at any time.
- Compliance with our legal obligations when we use Personal Data relating to you to comply with applicable law or when we protect our or our affiliates’, users’, or third parties’ rights, safety, and property.
- We will rely on our legitimate interests, which we believe are not overridden by your fundamental rights and freedoms, for the following purposes:
- Communications with you, including direct marketing where you are an existing customer, or where you make contact with us through our Site and other digital assets;
- Cyber security;
- Support, customer relations, Services operations;
- Enhancements and improvements to yours and other users’ experience with our Services;
- Fraud detection and misuse of our website and Services.

- Right of Access. You may request that we confirm to you whether or not we store Personal Data about you and to receive a copy of the Personal Data we maintain about you and information about: (a) the purposes of the processing of the Personal Data; (b) the categories of Personal Data being processed; (c) the names of the recipients or the categories of recipients to whom the Personal Data have been or will be disclosed, in particular recipients in third countries or international organizations; (d) if possible, the period we believe we will store the Personal Data, or the criteria we use to determine that period; (e) the sources of the Personal Data, if not collected from you; and (f) whether we use automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for you.
- Right to Rectify. You may request that we correct any Personal Data about you that we maintain that is incorrect. Depending on the purpose for which the data is used, you may also request to complete incomplete Personal Data we maintain.
- Right to Erasure (“Right to be Forgotten”). You may request that we erase or suppress Personal Data that relates to you in the following cases: the data is no longer needed by us; the data was collected and is used on the basis of your consent and you withdraw that consent; when you have a right to object to our use of the data (as described below under, “Right to Object”); we are not lawfully processing the data; or we are otherwise required by law to delete the data. However, there may be circumstances in which we may retain your data or we may refuse your request, for example, when we review the data to defend ourselves or make legal claims or exercise are own rights. In addition, this right may not apply to the display or access of your Personal Data outside of the European Union.
- Right to Restrict Processing. You may request that we restrict our use or processing of your Personal Data if: you claim the Personal Data is inaccurate, during the time we investigate your claim; our processing of the Personal Data was unlawful; we no longer require the Personal Data; we processed the Personal Data for our legitimate interests and you object to this use (as you are permitted to do under Article 21(1) of the GDPR), during the time that we investigate whether our legitimate interests override your request. However, there may be circumstances in which we are legally entitled to refuse your request.
- Right to Data Portability. You may request that we provide you with your Personal Data that we process based on your consent or to fulfill a contract with you or that we process using automated means, in a structured, commonly used and machine-readable format, and to transfer your Personal Data to another entity or have us transfer it directly to such entity.
- Right to Object. You may, based on reasons specifically relating to you, object to our processing of your Personal Data, when: (i) the data is used for our legitimate interests and our interests in processing the data does not override your interests, rights and freedoms and we do not require use of the data for the establishment, exercise or defense of our legal claims or rights; and (ii) we use the data for direct marketing purposes or profiling for direct marketing purposes.
- Right to Object to Automated Decision Making. You may request that you not to be subject to a decision based solely on automated processing, including profiling, when the decision produces legal effects concerning you or significantly affects you.Right to Withdraw Consent. Where we process Personal Data relating to you based on your consent (such as by clicking a check box adjacent to a statement of consent), you may withdraw your consent and request that we cease using your Personal Data for the purpose for which you have your consent, or altogether, depending on the situation.
If you exercise one (or more) of the above-mentioned rights, in accordance with the provisions under the law, you are entitled to request to be informed that third parties that hold Personal Data related to you, in accordance with this privacy policy, will act accordingly.
We will look into your query and make good-faith efforts to resolve any existing or potential dispute with you. Note that when you send us a request to exercise your rights, we will need to reasonably authenticate your identity and location. We will ask you to provide us credentials to make sure that you are who you claim to be and will further ask you questions to understand the nature and scope of your request. We may be permitted by law (including the GDPR and local national laws) to refuse or limit the extent to which we comply with your request.
Right to Make a Complaint. You have a right to file a complaint regarding our practices with a data protection authority.

- Transfers of Personal Data to other Countries outside the EU or EEA
We transfer Personal Data outside of the country it was collected in or outside of the European Economic Area (“EEA”) to Israel and to the USA. The laws of these territories may differ from the laws of the jurisdiction in which you live.
Appcharge is headquartered in Israel. As of the date of this Policy, the European Commission has determined that the State of Israel adequately protects Personal Data. If Personal Data from the EU is transferred outside the EU to our affiliates or to third-party service providers, to countries which the European Commission has not determined to adequately protect Personal Data, we take steps to ensure that such Personal Data receives the same level of protection as if it remained within the EU. This includes entering into data transfer agreements and using the European Commission approved Standard Contractual Clauses.
If you are a resident in a jurisdiction where transfer of Personal Data to another jurisdiction requires your consent, then your consent to this Privacy Policy means that you expressly and unambiguously consent also to such transfer of Personal Data.
If you are a resident of the EU (or any other jurisdiction that applies privacy in the same manner as GDPR), you may contact us in order to obtain additional information regarding the basis for the transfer of Personal Data relating to you to countries outside the European Economic Area. Please note that information or copies of documents we may provide to you in connection with such requests may be limited or redacted in order to protect the rights of third parties or to comply with contractual obligations we may have (such as obligations of confidentiality).
- California Do Not Track Notice.
We do not track individuals’ online activities over time and across third-party web sites or online services (though we do receive information about the webpage you visited prior to access our websites, products and services such as our Site and advertisement landing pages. We do permit third-parties to track individuals’ online activities on our Site, this includes Google and Facebook which provide us with the analytics and tracking services described above. - Third Party Websites, Services & Data Collection
Our Services may contain links to other websites, products or services offered by third parties (“Third Party Services”). This Policy does not apply to data collected by or on behalf of such third parties, whose privacy practices may differ from ours and who are not under our control. We are not responsible for the actions of such third parties or their data practices. Please review the privacy policies of any such third parties before you interact with them or provide them with Personal Data.
- Personal Data of Children
Our Services are not intended for, and we do not knowingly collect Personal Data from persons under the age of eighteen (18). If you believe that a person under the age of eighteen (18) has provided us with Personal Data, or if we have received the Personal Data of such person, please contact us at privacy@appcharge.com.
- Changes to This Privacy Policy
From time to time, we will need to update this Policy. If the updates have minor, if any, consequences, they will take effect 7 days after we post a notice on the Services’ platform and/or our Site, or after we send you the notice through email or through the Services. Substantial changes will be effective 20 days after we initially posted our notice. Changes to this Policy are effective as of the stated “last updated” date.
Continuing to use the Services or our Site after the new privacy policy takes effect means that you agree to the new Policy. Note that if we need to adapt the Policy to legal requirements, the new Policy will become effective immediately or as required.
